I know from personal experience that it takes time to find the right home business. Nonetheless, in the search and set up of your home business, you really need to keep some things in mind. 1. A home business is just that. It is a business which is set up so that you can work from home. With that having been said, most people forget that there are a lot of distractions that go along with operating a business from the same place that you sleep, shower, eat, watch television, etc. As a result, you need to be proactive in minimizing the chance for distractions early. Keep in mind that your spouse and/or children may have the most difficulty distinguishing your work time, from your “home time” since both are carried out in the same venue. They must set goals, write them down, schedule which actions need to be taken daily to accomplish those goals, and make sure that they take these actions until their goals are completed on time. Once you have achieved your goals for the day, your work day is finished.

3. I bet this did not cross your mind. When you run a home business, you are responsible for all of your supplies and equipment. More often than not, people forget to put this in their budget. Therefore, if you computer crashes, you have the expense of fixing or replacing it. If your home Internet goes out, and your business relies heavily on the Internet, you will have to probably go to the nearest coffee shop and work from there. You can no longer call up the help desk, and have the IT team come to your cubical. Furthermore, when all of your pens run out of ink, or your notebooks are full, you are the one shopping for supplies for your home business.

4. As a home business owner your responsibilities will now go through the roof. You are now both the CEO, CFO, COO, marketing department, sales team, and secretary. This means that you will not only have to make sales and take care of marketing, but you will also be in charge of accounts payable and accounts receivable.

5. Home business owners are also in charge of withholding their own taxes. When you run a home business, your income taxes are not being deducted from your paycheck every two weeks. As a result, it is important to know from the start which tax bracket you fall into, and set that money aside so that you can pay your annual income taxes. There is very good accounting software with accompanying books which will assist you greatly in this area. However, you may also consider hiring a tax expert if your business is generating enough income so that you can outsource this task.

I will leave you with this. I cannot stress enough how important it is that you engage in a home business which is highly interesting to you. If you do this, your will view your work more like a hobby, rather than a job. Mark my words with this one. You have the opportunity to create your dream job. Do not squander it.

Who Is a Seaman Under the Jones Act

Individuals who work offshore and on the water must be very careful when they sustain an injury at work. Most of these individuals will qualify as “seamen” under a Federal statute known as the Jones Act. The Jones Act allows an injured maritime worker to file a tort-based lawsuit against their employer and seek all damages caused by the injury including pain and suffering, lost wages and loss of fringe benefits. However, in order to file suit under the Jones Act the maritime worker must first meet the definition of a “seaman” under the Jones Act. This definition states that the employee must be “more or less permanently assigned to a vessel or fleet of vessels in navigation.”

The initial requirement is that the injured employee be “more or less permanently” assigned to vessels or fleets of vessels. The more or less permanently has generally been interpreted to mean that the employee spends at least 30% of his working time aboard a vessel or fleet of vessels. This has come to be known as the “30% Rule”. Usually this initial requirement is one of the easier requirements for the employee to satisfy since most maritime workers either spend a great deal of their time aboard vessels or they work land-based or fixed-platform jobs.

The next requirement is that the individual be assigned to work aboard a vessel or fleet of vessels. This does not necessarily require that the individual work aboard a traditional vessel such as a tug boat, supply vessel or crew boat. In the Gulf of Mexico as well as other regions there are many specialized structures that actually qualify as “vessels” under the Jones Act. Specifically, offshore jack up drilling rigs and semi submersible drilling rigs as well as crane barges and jack up boats all qualify as vessels under the definition of a seaman. The United States Supreme Court recent issued a case stating that any structure that is “typically capable of navigation” may meet the definition of a vessel under the Jones Act for purposes of seaman status.

It should also be noted under the definition of vessel that the employee does not necessarily have to be assigned to one specific vessel. The Jones Act allows an employee to qualify as a seaman even if he is assigned to several vessels which constitute a fleet of vessels. However, there is a requirement that this fleet of vessels be under common ownership or control. In other words, typically individuals who are randomly assigned to vessels owned, operated and controlled by many different parties will have a difficult time establishing that they were assigned to a fleet of vessels under common ownership or control. Austin wireline workers as well as other specialized workers in the Gulf of Mexico face this challenge in satisfying the definition of a seaman under the Jones Act.

The third requirement in order to satisfy the definition of a seaman under the Jones Act is that the individual be assigned to a vessel that is “in navigation”. This requirement has been very broadly defined and essentially means any individual that is in some way contributing to the mission of the vessel, a term that is also broadly defined. Typically the “in navigation” requirement will easily be met.

If a maritime worker is injured at work it is critical that he file his claim under the Jones Act in order to recover general damages including pain and suffering, lost wages and loss of fringe benefits. The only way this worker can file his claim under the Jones Act is if he meets the definition of a “seaman” under the Act. The above three requirements are very important and should be discussed with a qualified maritime attorney. Many maritime companies will intentionally file and handle an employee’s claim under the incorrect law rather than the Jones Act. It is up to the employee to research the law and determine if he can file his claim under the Jones Act in order to seek more recovery.

What to Expect at your Next Speech Pathologist Appointment

Speech is the production of sounds for the purpose of communication. It involves the use of the lips, tongue, teeth, palate, vocal cords, and lungs. Speech language pathology deals with problems with communication and conditions that make it difficult for a person to swallow. When one engages in speech pathology therapy, they will learn techniques and exercises to improve verbal communication.

The following outlines what one can expect when attending a speech pathologist appointment:

The first step is for a Speech Pathologist to acquire an assessment of the patient. This will include taking a patient’s medical history to get an accurate account of the nature of the speech problem. The speech pathologist will also observe the patient to get a sense of the problem. There may also be some simple tests given to the patient. The assessment appointment can take anywhere from 1- 2 takes hours. If it is a child that is being assessed, the parents will be actively involved in the assessment process.

Depending on the communication or swallowing problem, tests can include: repeating sounds and sentences for recording, taking an x-ray of the side of the palate, using a scope with a light to enter the nostril for visual assessment.

While sales may eventually be made, you had better know what you are doing because if not you will lose money at this venture. This is a risky business opportunity, because the company hiring you to do this is essentially paying you a commission for sales, if you pay for all of their advertising. If they could advertise successfully on their own, why would they pay you a commission? You are better off learning about affiliate marketing strategies, as this is essentially what the data entry work is, however, it is likely that the training, if any, provided by the company will be less than satisfactory.

2. Additional Training Necessary: Some jobs for transcription services may require special training because of the type of job and necessity for accurate data entry. Opportunities that ask for your hard earned money just to be eligible require you to look at the fine print. Getting an education is very rewarding, but doing something valuable with your new found knowledge is even better. If getting paid for your efforts by trading your time for money is your choice, be sure you know what will be required of you once you complete your training. If you have to go searching for a job after you finish your training, is it possible that you might be better off to just search for a traditional job. Rather than spending advertising or excessive training dollars, sometimes the better option would be to consider a low overhead internet business that could potentially earn much more than these high overhead data entry options.
